Step 1: Trademark search in Pakistan before you file
A search is not compulsory but it saves months. Check IPO-Pakistan's records for identical or similar marks in your class. A search covers only what is already on record, not marks filed this week.
Step 2: Choose the right class
Each application covers one class of goods or services. Choose carefully: trademark classes in Pakistan (Nice classification).
Step 3: File the application
File the application on the prescribed form with the filing fee (see trademark registration cost in Pakistan). A power of attorney is needed if an agent files for you.
Can you file online, and where is the Trade Marks Registry?
Yes. IPO-Pakistan launched online trademark filing, with online payment, in June 2023, so you do not have to visit an office to apply. The Trade Marks Registry itself is in Karachi (it was set up there in 1948), and IPO-Pakistan also has a Lahore office and a head office in Islamabad. If you live in Karachi, you can still file online and only go in person if the Registry asks you to.
Before you file, make sure your class is right. See trademark classes in Pakistan and the overview in trademark registration in Pakistan.
Step 4: Examination and objections
The registrar examines the mark, for example whether it is descriptive, too similar to an existing mark, or lacks distinctiveness. If objections are raised you must reply in writing within the time allowed, or the application can be abandoned.
Step 5: Publication and the two-month opposition period
Accepted marks are published in the Trade Marks Journal. Anyone can oppose within two months, extendable on request. If someone opposes, you file a counterstatement and the registrar decides.
Step 6: Registration and renewal
Pay the registration fee after acceptance to receive the certificate. Protection runs ten years from filing. Renew in time: trademark renewal and infringement in Pakistan.
